A judge has issued a new ruling in the ongoing custody battle between Halle Berry and her ex-husband, Olivier Martinez, over their 13-year-old son, Maceo.
According to TMZ, which spoke with Martinez’s attorney, Patrick Baghdaserians, Martinez will retain primary phyiscal custody after the judge rejected Berry’s request to restore their previous joint physical custody arrangement. The judge also dissolved the temporary domestic violence restraining order that had been granted to Martinez and ruled that Berry can no longer have overnight visits with their son.

Despite the ruling, Berry retains joint legal custody and reportedly has tie-breaking authority when the former couple cannot agree on certain decisions, according to TMZ. The judge will revisit the formee couple’s custody arrangements next month. Martinez’s request to restrict Berry’s parenting time during holidays was also denied.
The latest court decision follows allegations stemming from a September 26th incident at Berry’s home.
According to Martinez’s court filing, Maceo contacted his father and alleged that Berry physically attacked him while he was playing his video game. Martinez accused Berry of grabbing their son by the neck and choking him. He eventually sought a temporary domestic violence restraining order and changes to their custody arrangement.

Berry denied the allegations, describing the interaction as playful wrestling and maintaining that she never choked or restricted their son’s breathing.
Maceo later testified during a closed court hearing as part of the proceedings. The details of his testimony have not been made public.
